Comments, exceptions and qualifications A trademark registration becomes vulnerable to cancellation only if a cancellation decision is issued by the Board of Grievances (The First Instance Court) on an appeal filed by any interested third party against the non-use of the same for a period of five years in succession from the registration date, otherwise, no cancellation action will be taken by the TM Registrar.
